Claims Against the Estate

Certain people can claim against estates.  If you’ve been left out of a Will or perhaps not been provided adequate provision from an estate, you may be able to bring an Application for further provision under the Succession Act 1981.

Equally, you may be in a position of defending such a claim against an estate of which you are an executor. The majority of these claims can be settled out of court with the right negotiation and advice.

In addition, there are many other claims that can be brought against the estate of a deceased person. This, for example, may be a claim that the testator did not have capacity to make the Will, or that an alternate document is the true intentions of the testator and not the last Will.
